HSC Helper – Terms of Service

Welcome to HSC Helper ("HSC Helper", "we", "our" or "us"). These Terms of Service ("Terms") govern your access to and use of our websites, mobile applications, browser extensions, application programming interfaces (APIs), and any related services (collectively, the "Service").

Please read these Terms carefully. By creating an account, accessing, or using the Service you agree to be bound by these Terms and our Privacy Policy and any referenced policies or guidelines (together, the "Agreement"). If you do not agree, do not use the Service.


1. Who May Use the Service

1. Minimum Age & Educational Context.

HSC Helper is designed for senior‑secondary students in New South Wales, Australia. You may only use the Service if you are:

  • Aged 13 years or older and have verified parental or legal guardian consent if you are under 18
  • Aged 18 years or older and legally able to enter into a contract

2. Parental Consent & Supervision.

Because many users are minors, parents or legal guardians ("Guardians") who create or supervise an account for someone under 18 agree to:

  • Review these Terms and our Privacy Policy
  • Consent to the collection, use and disclosure of the minor's personal information as described herein and in our Privacy Policy
  • Ensure the minor's use complies with this Agreement
  • Be responsible for all activity on the account

3. Education Provider Accounts.

Schools and teachers creating class accounts must obtain and document appropriate Guardian consent before enrolling students under 18.

2. Your Account

  • You must provide accurate, complete and up‑to‑date information (including a valid email address) and keep it updated
  • You are responsible for safeguarding your password. Do not share your login credentials
  • You are responsible for all activity that occurs under your account
  • We may suspend or terminate your account if we reasonably believe you have breached these Terms

3. Privacy and Personal Data

1. Data We Collect.

When you use the Service we collect and store the following personal information:

  • Identity Data: Email address, first name, last name, profile picture (optional)
  • Educational Data: Past quizzes, upcoming assessments, marked questions, explained questions, user feedback, and any other content you submit via the Service

2. How We Use Data.

We process personal information to:

  • Deliver, personalise and improve the Service
  • Provide study analytics and recommendations
  • Communicate with you about your account and updates
  • Protect the integrity and security of the Service

3. Legal Basis & Children's Privacy.

Our processing complies with the Australian Privacy Principles and, when dealing with minors, the Office of the Australian Information Commissioner's (OAIC) guidelines on children's privacy. We rely on:

  • Consent (from Guardians for users under 18) for collection of educational data
  • Legitimate interests for security, service maintenance and fraud prevention

4. Data Retention.

We retain personal information only for as long as necessary to fulfil the purposes above or as required by law. You or your Guardian may request deletion at any time.

5. Your Rights.

Subject to law, you (or your Guardian) may request access, correction, deletion, or export of your personal data by emailing hello@hschelper.com.

4. User Content

1. Definition.

"User Content" means any material you upload, submit, store, post, or otherwise make available through the Service, including quizzes, answers, messages, files, and profile information.

2. Ownership.

You retain ownership of your User Content. These Terms do not transfer ownership.

3. Licence to HSC Helper.

By submitting User Content, you grant HSC Helper a worldwide, royalty‑free, non‑exclusive licence to host, reproduce, analyse, modify (for formatting, scoring, or feedback generation), communicate, and display such content only for the purpose of operating, improving, and providing the Service.

4. Educational Integrity.

You must not upload content that breaches academic integrity rules (e.g. exam questions under embargo, copyrighted textbooks). HSC Helper may remove or block access to infringing content.

5. Acceptable Use

You agree not to:

  1. Use the Service for unlawful, deceptive, or harmful purposes (including bullying or harassment)
  2. Violate the privacy, publicity or intellectual‑property rights of others
  3. Upload harmful code or interfere with security features
  4. Access or collect data from the Service using automated means without permission
  5. Reverse engineer or attempt to obtain the source code or underlying models, except as permitted by law
  6. Encourage or assist anyone to do any of the above

We may suspend or terminate your access and remove content that violates these Terms or applicable laws.

6. Intellectual Property

1. Our Content.

The Service, including all software, design, text, graphics, trademarks, and logos, is owned by HSC Helper or its licensors and protected by Australian and international intellectual‑property laws. Except as expressly permitted, you must not use our marks or content without prior written permission.

2. Feedback.

If you send suggestions or ideas, you grant us a perpetual, worldwide, royalty‑free licence to use, modify, and incorporate them without compensation.

7. Third‑Party Links & Integrations

The Service may link to or integrate with third‑party websites or services (e.g. school learning platforms). We do not control these services. Your use of third‑party services is at your own risk and subject to their terms and privacy policies.

8. Paid Features (if applicable)

Certain features may require payment ("Premium"). Prices include GST unless stated otherwise and are quoted in Australian dollars. By purchasing Premium you authorise us or our payment processor to charge your selected payment method. Premium plans automatically renew unless cancelled before the end of the current billing period. Refunds are provided as required by the Australian Consumer Law (ACL).

9. Termination

You may stop using the Service at any time and may delete your account in your settings or by contacting hello@hschelper.com. We may suspend or terminate your access if you breach these Terms, create risk for us, or if legally required. Upon termination these Terms cease except sections that by nature should survive (e.g. licences, disclaimers, limitation of liability).

10. Disclaimers

1. Educational Tool.

The Service provides study aids and analytics for educational purposes only. HSC Helper does not guarantee specific marks, grades, or outcomes.

2. No Professional Advice.

Content is not a substitute for professional educational or mental‑health advice.

3. "As Is".

The Service is provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. However, non‑excludable consumer guarantees under the ACL still apply.

11. Limitation of Liability

To the fullest extent permitted by law, HSC Helper is not liable for any indirect, incidental, special, or consequential loss, or loss of data, profits, or revenue arising from the use of the Service. Where liability cannot be excluded but can be limited under the ACL, our liability is limited to re‑supplying the Services or paying the cost of re‑supply.

12. Indemnity

You agree (and, for minor users, your Guardian agrees) to indemnify and hold HSC Helper, its directors, employees, and agents harmless from any claims, damages, and expenses (including legal costs) arising from your breach of these Terms, User Content, or unlawful conduct.

13. Changes to these Terms

We may amend these Terms from time to time. We will post the updated Terms and change the "Last updated" date. Material changes will be notified via email or in‑app notice at least 14 days before they take effect. Continued use after the effective date constitutes acceptance of the amendments.

14. Governing Law & Disputes

These Terms are governed by the laws of New South Wales, Australia. You submit to the exclusive jurisdiction of the courts of New South Wales. If you have a dispute, please contact us first. We will endeavour to resolve disputes informally within 30 days.
